WETA is committed to developing the Central Bay Operations and Maintenance Facility in the most environmental-friendly manner feasible, ensuring that the public funds supporting this project are utilized in a manner that minimizes any ecological impact of constructing and operating new facilities along the shoreline of San Francisco Bay. Environmental review of the Central Bay Operations and Maintenance Facility Project is required under provisions of the California Environmental Quality Act (CEQA) and the National Environmental Protection Act (NEPA). Additionally, other state, local and Federal agencies have jurisdiction over the project area and/or resources that could potentially be impacted by the project.

California Environmental Quality Act (CEQA) | Status: Complete

On April 1st, 2011, WETA submitted a Notice of Intent to Adopt a Mitigated Negative Declaration to the State Clearinghouse (SCH#: 2011042005) providing a brief description of the proposed project, establishing a 30-day period for public comments extending through May 2, 2011, and listing project contacts for additional information. The Initial Study/Mitigated Negative Declaration identifies potentially significant impacts associated with the project including aesthetics, air quality, biological resources, greenhouse gas emissions, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, noise, transportation/traffic, and mandatory findings of significance. Mitigation measures identified in the document and included in the project will reduce all potential impacts to a less-than-significant level.

On June 7th, 2011, WETA filed a Notice of Determination advising the State Clearinghouse and Alameda County Clerk that the WETA Board had approved the project and adopted a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the project on June 2nd, 2011. National Environmental Protection Act (NEPA) | Status: Complete

On May 30, 2013 the Federal Transit Administration (FTA), the federal lead agency for the project, issued a determination that the Central Bay Operations and Maintenance Facility project qualifies for a documented categorical exclusion under 23 CFR Part 771.118(d). The determination was made in consultation with the US Fish and Wildlife Services and National Marine Fisheries Services and finds that the project: does not induce significant environmental impacts to planned growth or land use for the area; does not require the relocation of significant numbers of people; does not have a significant impact on natural, cultural, recreational, historical or other resources; does not involve significant air, noise, or water quality impacts; does not have significant impacts on travel patterns; or does not otherwise, either individually or cumulatively, have any significant environmental impact.

Additionally, other state, local and Federal agencies have jurisdiction over the project area and/or resources that could potentially be impacted by the project. The following major permits and approvals will be required:

    • City of Alameda - Approval of long-term lease for construction and operation of new facilities within City jurisdiction. (Complete, March 2015)
    • City of Alameda - Design Review approval and approval of Use Permit and Building Permit. (Complete, March 2015)
    • National Marine Fisheries Service - Section 7 Endangered Species Act and Essential Fish Habitat consultations. (Complete, October 2012)
    • National Marine Fisheries Service - Marine Mammal Protection Act consultation. (Complete, February 2015)
    • San Francisco Bay Conservation and Development Commission - Major Permit and Federal Consistency Certification, including Design Review approval. (Complete, June 2015)
    • San Francisco Regional Water Quality Control Board - Clean Water Act Section 402 and Section 401 water quality certification for placement of fill into waters of the United States and for approval of dredging. (Complete, March 2014)
  • State Historic Preservation Office - National Historic Preservation Act Section 106 consultation related to potential impacts to historic resources. (Complete, April 2012)
